Creative Shadows Promotions Private Limited (‘Creative Shadows’) is the appointed supplier of Nissan Motor India Private Limited (‘Company’ or ‘NMIPL’) for its merchandise business and operates nissanmerchandise.in (the “Website”). The Website provides information, advertises, and sells products subject to these Terms and Conditions (“Terms”). For purposes of these Terms, “Products” refers to items offered for sale and any services made available through the Website.

  1. Acceptance of Terms

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms may be amended at any time, and the updated version will replace the previous versions. Continued use of the Website constitutes acceptance of the revised Terms.

  1. Website Content

Whilst every effort is made to update the information on this website on a regular basis, nissanmerchandise.in makes no representations or warranties, whether express, implied in law or residual, as to the accuracy, completeness or reliability of any information, data and/or content on the website from time to time.  nissanmerchandise.in reserves the right at any time to change or discontinue without notice, any aspect or feature of the website and any information, data and/or content on the website.

  1. Return & Replacement Policy

3.1 “Definition of Return” shall mean the process by which a customer sends back merchandise purchased through the Nissan platform and a return may be initiated if the customer is not satisfied with the product quality, defective, damaged or not as described within the stipulated return period. Upon acceptance of a valid return, the customer shall be entitled to a refund of the purchase price.

3.2 No Return Policy: Nissan Merchandise Products are sold under a strict “no refund” policy, and NMIPL shall bear no liability for customer dissatisfaction relating to product quality, description, or condition; customers may only seek replacement at the nearest showroom.

3.3 “Definition of Replacement” shall mean the supply of a new unit of the same merchandise in lieu of the originally delivered item, where the latter is found to be defective, damaged, or otherwise non-conforming. Replacement shall be provided only upon verification of the defect or damage and subject to availability of stock.

3.4 Replacement Periods

  • Non-discounted items: Replacement accepted within 7 calendar days of receipt.
  • Discounted/Sale items: Replacement accepted within 3 calendar days of receipt.
  • No replacement will be accepted after these periods.

3.5 Condition of Send Back Items

Send Back items must:

  • Be in re-sellable condition.
  • Have original packaging, labels attached, and no damage or signs of wear.
  • Not be disassembled, altered, used, installed, attached, combined, or embedded in any way.

3.4 Instructions for Product send back for Replacement

  1. Do not return items directly to the warehouse.
  2. Email a return request to support@nissanmerchandise.in, including:
    • Your order number
    • Item details
    • Reason for return
  3. Orders department will contact you to provide nearest dealer details &  tentative timelines for replacement of the item/s.

3.5 Additional Replacement Conditions

  • Approval of replacement requests shall be at the discretion of nissanmerchandise.in.
  • Products will not be eligible for replacement if they have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined or added to, blended or combined with, or embedded within, other goods or property. This includes products & packaging that have been worn or damaged.
  • We do not accept returns after 7 calendar days, however, in case of genuine return requests, we will look at each request and consider approving at our sole discretion.
  • Shipping and handling charges are not refundable, unless an order has arrived damaged, faulty, incorrect or missing. The customer service team will use their discretion to evaluate whether a refund for shipping and handling may be waived.
  • Once a request for a replacement has been logged and approved by nissanmerchandise.in, you will be sent an email to confirm that our courier partner will arrange a collection date and time with you.
  • Item/s returned without original packaging or with damaged packaging will be returned to sender without refund.
  • Include the original invoice inside the package.

 

  1. Warranty 

Nissan Merchandise is sold without any warranty, express or implied, including but not limited to quality, durability, or fitness for purpose. Replacement is allowed only if:

  1. the product is received broken or damaged,
  2. a wrong product is delivered, or
  • apparel has a size issue. In such cases, buyers must email supporting images and details to support@nissanmerchandise.in. Upon verification, the supplier will arrange replacement.

No refunds or exchanges (replacement with another product of equal value) are permitted for dissatisfaction, non-conformity, or damaged receipt.

  1. Order Performance & Availability

Reasonable efforts will be made to fulfil orders within the notified timelines. Display of a product on the Website does not guarantee stock availability. nissanmerchandise.in, will notify you if a product becomes unavailable.

  1. Privacy & Security

All personal information collected by the Website is managed according to our Privacy Policy. Reasonable security measures shall be implemented to protect personal data transmitted through the Website.

  1. Intellectual Property

All content on the Website—including text, images, logos, product descriptions, and software—is the property of the Company. You may not copy, distribute, or use any content without prior written consent of the Company.

  1. Limitation of Liability

Company and/or Creative Shadows shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Losses arising from your use of—or inability to use—the Website
  • Errors, omissions, or inaccuracies in Website content

This limitation applies to the fullest extent permitted by law.

  1. Indemnity

You agree to indemnify and hold the Company, its employees, and agents harmless from all claims, losses, damages, and expenses arising from your breach of these Terms or misuse of the Website.

  1. Force Majeure

Company or Creative Shadows is not liable for failure to perform its obligations due to events beyond its control, including natural disasters, system failures, strikes, or other unforeseen circumstances.

  1. Governing Law

These Terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of courts located at Delhi, India.
